New Law Creates Oklahoma Medical Marijuana Transporter Agent License | What You Need To Know

A new law creates an agent license for businesses that have a marijuana transportation license, said Tulsa medical marijuana attorney Stephen Cale.

“Medical marijuana businesses with transportation licenses didn’t know if their employees were covered by the licenses. The new transportation agent license alleviates that concern,” Cale said.

The Oklahoma Medical Marijuana and Patient Protection Act (House Bill 2612) creates the new transporter agent license. The Act is commonly referred to as the Unity Bill. Gov. Kevin Stitt signed the Unity Bill on March 14, 2019.

The law takes effect 90 days after the Legislature adjourns, which must occur by 5 p.m. May 31, said Tulsa medical marijuana attorney Stephen Cale. So, if the Legislature adjourns on that date, the law will take effect on Aug. 29, 2019.

WHAT IS A TRANSPORTER AGENT?

The new law defines “transporter agent” as a person who holds a transporter agent license and transports medical marijuana or medical marijuana products for a licensed transporter.

WHAT IS THE TRANSPORTER AGENT LICENSE?

The transportation agent license qualifies an agent, employee, officer or owner of a transportation license to transport medical marijuana or product.

A transporter agent may possess marijuana at any location while the transporter agent is transferring marijuana to or from a licensed medical marijuana business, medical marijuana research facility or medical marijuana education facility.

HOW MUCH DOES THE TRANSPORTER AGENT LICENSE COST?

The annual fee for the license is $100. An individual or transporter license owner can pay for it.

WHAT ARE THE QUALIFICATIONS FOR THE TRANSPORTER AGENT LICENSE?

The Oklahoma Medical Marijuana Authority must issue each transporter agent a registry identification card within thirty (30) days of receipt of:
1. The name, address, and date of birth of the person;
2. Proof of residency as required for a medical marijuana business license;
3. Proof of identity as required for a medical marijuana business license;
4. Proof of a valid Oklahoma driver license;
5. Verification of employment with a licensed transporter;
6. The application and affiliated fee; and
7. A criminal background check conducted by the Oklahoma State Bureau of Investigation paid for by the applicant.

HOW LONG IS A TRANSPORTER AGENT LICENSE GOOD FOR?

The registry identification card for a transporter expires one year after the date it’s issued, said Tulsa medical marijuana attorney Stephen Cale. It also expires when a transporter license holder notifies the OMMA that the transporter agent ceases to work as a transporter.

CAN THE OMMA REVOKE OR SUSPEND A TRANSPORTER AGENT LICENSE?

The OMMA may revoke the transporter agent card if the transporter agent knowingly violates the law governing the transportation of marijuana, and the transporter is subject to any other penalties established by law for the violation.

Also, the OMMA may revoke or suspend the transporter license
of a transporter that the OMMA determines knowingly aided or facilitated a violation of any provision of the law governing the transportation of marijuana, and the license holder is subject to any other penalties established in law for the violation.
