New state law requires additional labeling requirements for products containing CBD, said Tulsa medical marijuana attorney Stephen Cale.
The law went into effect on November 1, 2019. Any manufactured product containing cannabidiol (CBD) must have a label that contains, at a minimum:
- 1. The country of origin of the cannabidiol; and
- 2. Whether the cannabidiol is synthetic or natural.
However, the new law does not apply to any pharmaceutical product approved by the Food and Drug Administration.
CBD is extracted from hemp, which refers to the non-intoxicating varieties of cannabis. Hemp-derived CBD products contain less than 0.3% THC. So, they do not produce the high typically associated with marijuana.
Under the new law, retail sales of industrial hemp and hemp products may be conducted without a license under certain conditions, said Tulsa medical marijuana attorney Stephen Cale. First, the products and the hemp used in the products must be grown and cultivated legally in Oklahoma, or another state or jurisdiction. Secondly, the product must meet the same “or substantially the same” requirements for processing hemp products or growing hemp.
The law permits adding derivatives of hemp, including hemp-derived cannabidiol, to cosmetics, personal care products and products intended for human or animal consumption without a license. Adding the derivatives can not be considered an adulteration of those products.
However, the new law does not exempt any individual or entity from compliance with food safety and licensure laws, rules and regulations as set forth under the Oklahoma Public Health Code, Cale said.
