A state lawmaker wants to eliminate an agriculture tax exemption for marijuana producers, said Tulsa marijuana licensing attorney Stephen Cale.

Nearly all things used in agriculture production are exempt from Oklahoma state sales tax.  That exemption includes “items to be and in fact used in the production of agricultural products,” Cale said.

But State Sen. David Bullard (R-Durant) recently filed SB 133 to eliminate that exemption for medical marijuana producers. His proposed law states that agriculture products “shall not include the growing, harvesting, and processing of marijuana ….”

Last year, a similar bill was introduced but it died, Cale said.

Bullard also is the author of SB 116, which would require marijuana growers to be a certain distance from “places of worship.” See Oklahoma Lawmaker Wants Marijuana Grows Away From Places of Worship.

Another bill to impose distancing requirements for dispensaries also has been filed, said Tulsa marijuana licensing attorney Stephen Cale. See Bill Seeks to Distance Dispensaries From Places of Worship.

The deadline for introducing bills for the 2023 session is Jan. 19, 2023. The Legislative session begins at noon Feb. 6, 2023.
